If the reason an employee resigned is the behaviour of his, or her employer, then there is a possibililty that this will be seen as amounting to constructive dismissal. For a tribunal to be convinced that this is the case they will have to be shown that:

  • your employer has committed a serious breach of contract
  • you believe that you were ultimately forced to leave as a result of the employer's behaviour
  • your behaviour cannot be interpreted in such a way as to construe that you accepted the breach
